Terms and Conditions

 Please read these Terms and Conditions carefully before you start to use our website before purchasing or booking any services through our website.

 

By using our website, you confirm that you accept these Terms and Conditions and that you agree to comply with them regardless of whether you choose to register with us.

 

All participants must sign the MOTION Health & Safety Waiver on their Mindbody Account prior to attending an in-studio or online class. It is the responsibility of the client to ensure they have understood and signed the waiver and are in a good state of health before participating in a class or event.



Introduction

Welcome to MOTION (trading under Motion London Ltd). These Terms and Conditions govern your use of our services and the Mindbody booking platform. By booking classes or participating in our services, you agree to these terms. If you do not agree, please do not use our services.

Booking Classes

  • Booking Process: All class bookings are made through the Mindbody platform. You will need to create an account and provide accurate information to book classes.

  • Payment: Payments for classes, memberships, and packages are processed through Mindbody. Accepted payment methods are listed on the Mindbody platform.

  • Confirmation: Once your booking is completed, you will receive a confirmation email or SMS from Mindbody. It is your responsibility to ensure the details of your booking are correct.

 

Pricing
Information displayed on the website related to pricing and service availability is subject to change by MOTION without notice.

 

Monthly Memberships

  • Monthly Unlimited including promotional memberships (e.g. ‘Founders’) are rolling monthly contracts and can be cancelled with 1 months’ written notice to hello@motionlondon.co.uk

  • Activates upon date of first visit and auto renews on that date thereafter.

  • Pass valid for use by named pass holder only.

  • Not eligible for refunds or transfer.

  • Refunds for class cancellations or other issues will be processed according to Mindbody’s procedures. Refunds are issued to the original payment method.

  • If the client wishes to ‘freeze’ their account, they must be requested by emailing hello@motionlondon.co.uk, and 48 hours’ notice must be given prior to the ‘freeze’ start date.

  • Each member has the option to ‘freeze’ once per year for a duration of 2 weeks. This is a one time freeze typically used for Vacation purposes.

  • Holds requested for injury/illnesses beyond 2 weeks need to be accompanied by a doctor’s note.

 

 

Class Pack Expiries

  • 20 Classes: 6 months expiry from date of purchase

  • 10 Classes: 3 months expiry from date of purchase

  • 5 Classes: 2 months expiry from date of purchase

  • 1 Class/ Drop-in: 2 weeks expiry from date of purchase

  • Promotional offers e.g. ‘3 Classes for £30’: 1 month expiry from date of purchase

Cancellation Policies

  • Class Cancellations: You may cancel your class booking through the Mindbody platform. MOTION’s class cancellation policy is 9 hours. If you do not cancel with at least 9 hours prior notice, this will constitute as a late cancel and your credit will not be returned to your account. If you have a monthly membership, you will be charged £8 late cancellation fee and a £10 no show fee. To receive a refund or credit, cancellations must be made at least 9 hours before the class start time. Those on class packs won’t have their credits returned without 9 hours’ notice.

  • ClassPass or other external third-party bookings are liable to their cancellation policy. We cannot override this.

  • Membership and Package Cancellations: Please note that memberships and class packages purchased through Mindbody are non-refundable. If you need to cancel, please provide at least 1 months’ notice in writing to hello@motionlondon.co.uk.

 

Promotions & discounts

  • Corporate discounts can be provided on request.

  • Promotions cannot be combined or backdated.

Attendance and Late Arrivals

  • Arrival Time: Please arrive at least 10-15 minutes before the scheduled start time of your class. Late arrivals may not be allowed to join the class for safety reasons.

  • Participation: Inform the instructor of any health issues or injuries before the class begins. We reserve the right to refuse participation if deemed necessary for safety reasons.

 

Conduct and Behaviour

  • Studio Etiquette: Maintain respectful behaviour towards our staff and fellow participants. Silence or turn off mobile phones before entering the class.

  • Personal Items: We are not responsible for any personal items lost or stolen in the studio. Please keep your belongings secure.

  • Behaviour Policy: We have a zero-tolerance policy for inappropriate or disruptive behaviour. We reserve the right to remove members from current and future classes if they do not adhere to our standards of respect and conduct.

 

Health and Safety

  • Medical Conditions: Consult with a healthcare professional before participating if you have any medical conditions or injuries. Inform the instructor of any conditions that may affect your practice.

  • Liability: Participation in our classes is at your own risk. We are not liable for any injury or loss sustained while attending classes or using our facilities.

  • Waiver: All participants must sign the MOTION Health & Safety Waiver (see below) on their Mindbody Account prior to attending an in-studio or online class. It is the responsibility of the client to ensure they have understood and signed the waiver and are in a good state of health before participating in a class or event.

·       Health & Safety Waiver
I agree to the following:

·       Acknowledgement of risk
The participant acknowledges that there is a risk of injury or illness when participating any MOTION class (Yoga, Pilates, Barre and/or Sound Bath).

·       Waiver of claims
The participant waives any claims they may have against the instructor, MOTION, or other parties for injury or damage.

·       Acceptance of responsibility
The participant accepts full responsibility for any risks or injuries that may occur.

·       Consent to medical treatment
The participant consents to receiving medical treatment if they are injured or become ill during a class.

·       Awareness of special needs
The participant acknowledges that certain activities may not be suitable for people with special needs (including during pregnancy/ post-natal) or other health conditions.

·       Acknowledgment of non-medical substitute
The participant acknowledges that MOTION classes (Yoga, Pilates, Barre and/or Sound Bath) are not a substitute for medical attention, diagnosis, or treatment.

·       Agreement to consult a physician
The participant agrees to consult a physician before beginning any MOTION class (Yoga, Pilates, Barre and/or Sound Bath) if there is a concern.

 

Changes to Classes and Services

  • Class Schedule: We reserve the right to change or cancel classes, instructors, or schedules. We will make reasonable efforts to notify you of any changes via Mindbody notifications.

  • Service Modifications: We may modify or discontinue services at our discretion. Significant changes will be communicated through the Mindbody platform.

 

Gift cards

  • Please protect your Gift Card and treat it as cash; we cannot replace lost, stolen or damaged cards.

  • The gift card will expire 12 months from purchase. We will not refund any balance remaining and we will invalidate the card.

  • Gift cards cannot be exchanged for cash. We do not give change or refunds on gift cards or e-gift cards.

  • If you are using a Gift Card online and the total order value is less than the value of the card, any balance will remain on the card and may be applied to future purchases, provided that the card has not expired. However, a Gift Card cannot be used for partial payment online for monthly subscriptions.

  • We reserve the right to refuse to accept a gift card which we deem to be tampered with, duplicated or which otherwise is suspected to be affected by fraud.

  • We reserve the right to amend the gift card and e-gift card terms and conditions from time to time, where we consider it reasonable and necessary to do so.

 

Privacy

We are committed to protecting your privacy. Our Privacy Policy outlines how we collect, use, and protect your personal information, including information collected through the Mindbody platform. Please review our Privacy Policy for details.

 

Intellectual Property

All content on our website, Mindbody platform, and studio is the property of MOTION (trading under Motion London Ltd). You may not reproduce or use this content without our express permission.

 

Intellectual Property and Right to Use

  • Ownership: All copyright, trademarks, and other intellectual property rights in the material and content provided on our website remain vested in us or our licensors. You are permitted to use this material only as expressly authorized by us or our licensors.

  • Personal Use: You may use the material and content from our website for your personal, non-commercial use only. This includes downloading content to one computer hard drive as necessary to make a purchase. Any other use, including copying, reproducing, transmitting, publishing, displaying, distributing, commercially exploiting, or creating derivative works, is strictly prohibited.

  • Submissions: By submitting any material or content to us (e.g., via email, posting, or submission forms), you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, publish, exploit, and modify such material. We may use any ideas, concepts, content, text, or images contained in your communications for any purpose.

 

Indemnity

You agree to indemnify, defend, and hold harmless us, our officers, directors, employees, agents, and suppliers from any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from:

  • Any breach of these Terms and Conditions by you.

  • Any use of our website or services by any other person using your account or personal information.

 

Our Rights

  • Website Modifications: We reserve the right to modify or withdraw the website (or any part of it) temporarily or permanently, with or without notice. We will not be liable to you or any third party for any modifications or withdrawal of the website.

  • Changes to Terms: We may change these Terms and Conditions from time to time. Your continued use of the website following any changes constitutes your acceptance of such changes. It is your responsibility to review these terms regularly. If you do not agree to any changes, you must stop using the website immediately.

 

Compliance with Laws

The website and our services may only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes, and regulations regarding the website and any transactions conducted through it.

We do not limit our liability for death or personal injury resulting from our negligence or that of our employees.

Each provision of these Terms and Conditions is intended to be separate and will remain in effect even if any provision is found to be invalid or unenforceable.

 

Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
